Terms and Conditions – Building & Timber Pest Report Sales
These Terms and Conditions apply to all purchases made through our online store at reports.leadingbuildinginspections.com.au. By purchasing a report, you agree to be bound by these Terms and Conditions.
1. Background
We prepare building inspection reports in accordance with Australian Standard AS4349.1-2007 (Pre-purchase Inspections – Residential Buildings).
We prepare timber pest inspection reports in accordance with Australian Standard AS4349.3-2010 (Inspection of Buildings – Timber Pest Inspections).
You are purchasing access to a completed report relating to the property specified on our website.
Once payment is received, we will email the report to you at the address you provide at checkout.
2. Acceptance
You accept this Agreement when you complete the checkout process, including entering your payment details.
3. Payment and Delivery
Payment must be made in full at checkout by the methods displayed on our website.
Once payment is confirmed, the report will be sent to your nominated email address, usually within 1 business day.
Delivery is digital only. No printed copy will be provided unless agreed otherwise.
4. Nature of Reports
Reports are based on a visual inspection conducted on the date specified within the report.
Reports are prepared for the property owner or commissioning client at the time of inspection and are made available for purchase by subsequent interested parties (such as prospective buyers).
Reports do not constitute a guarantee, warranty, or insurance policy against future issues with the property.
Reports are valid as at the date of inspection only. Conditions of the property may change after that date.
5. Building Inspection Report – Disclaimers and Limitations
By purchasing a Building Inspection Report, you acknowledge and agree that:
The inspection was visual only and limited to areas safely accessible at the time of inspection.
No invasive procedures were undertaken – the inspector did not cut, dismantle, drill, move furniture, lift floor coverings, or otherwise disturb the property.
Concealed, inaccessible, or hidden defects (including but not limited to those behind walls, beneath flooring, in roof voids, or under stored goods) were not inspected and may exist.
The report does not cover:
Electrical systems or wiring (must be checked by a licensed electrician).
Plumbing, gas, or drainage systems (must be checked by a licensed plumber).
Asbestos identification or testing.
Mould or non-wood decay fungi.
Strata or common property areas.
Compliance with building codes, regulations, or council approvals.
Weather conditions at the time of inspection may conceal certain defects (e.g., leaks not visible during dry weather).
The report does not and cannot identify all defects or future maintenance requirements.
Cost estimates, if provided, are general only and must not be relied upon as quotations.
6. Timber Pest Inspection Report – Disclaimers and Limitations
By purchasing a Timber Pest Inspection Report, you acknowledge and agree that:
The inspection was visual only and limited to areas safely accessible at the time of inspection.
No invasive procedures were undertaken – the inspector did not cut, drill, gouge, or dismantle building elements.
Concealed termite or timber pest activity may exist in inaccessible areas (e.g., wall cavities, roof voids, beneath floors, behind insulation).
The report does not guarantee that the property is free of timber pests or damage. It only records what was visible at the time of inspection.
The report does not assess or certify structural soundness of the building. If timber pest activity was noted, structural damage may exist and must be investigated by a suitably qualified builder, engineer, or architect.
The report does not include:
Asbestos identification or testing.
Mould or non-wood decay fungi.
Inspection of timbers below ground level, tree stumps, or inaccessible fence posts.
Strata or common property areas.
Weather, occupancy, and stored items may conceal evidence of timber pest activity.
7. Refunds
As reports are delivered electronically and contain valuable information, refunds will not be provided once a report has been delivered, except where required by the Australian Consumer Law (ACL).
If a technical issue prevents delivery, please contact us and we will resend the report.
8. Intellectual Property
All reports are our intellectual property.
By purchasing a report, you are granted a non-exclusive licence to use the report for your personal due diligence purposes only.
Reports must not be copied, distributed, or resold without our prior written consent.
9. Liability
To the maximum extent permitted by law, we are not liable for any:
Loss, damage, claim, or expense arising out of your reliance on a report.
Future defects, deterioration, or pest activity that occurs after the inspection date.
Hidden or concealed issues not reasonably detectable at the time of inspection.
Assumptions that the property complies with laws, codes, or approvals.
Decisions you make to purchase, sell, or renovate a property based on a report.
Our liability, if any, is limited to resupplying the report or refunding the purchase price.
10. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law.
11. Governing Law
These Terms are governed by the laws of the state or territory in which the property is located, and each party submits to the jurisdiction of its courts.
